The word talaqnama is derived from the Arabic word Talq. According to the Encyclopedia of Islam, the Arabic term provides two verbs Talqana and Talqanah. The former means "to tear in pieces" and it's applied often in legal matters when a person is divorced, whereas the latter one means "to annul by saying 'I divorce you'" or "to anathematize". The two terms are also used in Islamic jurisprudence but they have different meanings because in this context Talqanam means divorce papers which are signed by husband and wife before witnesses or at least one of them has expressed his desire to end his marital relationship with notifying her. A talaqnama is the document used in Islamic law to initiate the divorce procedure between individuals after marriage. Although, talaqnama is usually written by husband himself but it's also possible that wife may write it for him because wife has full right on her property and assets. However, if husband himself writes his talaqnama, then all rights will be reserved on his half of property or assets. The initiating party is required to publish three public announcements (some schools of sharia require two public announcements) before any divorce procedure takes place. After this, the final talaq is said which marks the end of marriage and it's followed by a divorce. The documents may be registered in the court to continue with legal proceedings. However, if both parties want to move on and share mutual respect for each other, they may agree on khula where wife simply request her husband for divorce and she will receive it without any costs or financial obligations. However, she will have to pay for her own personal expenses including the provision of her own residence. If husband initiates first talaq then he must first register it in the court before making any actions. Then wife has to register it in the court before moving on with legal procedures. Then she can go for khula according to the financial arrangements made between both partners. If both spouses agree on khula, then they must file an application with the court for dissolution of marriage. Upon their decision, they will receive a divorce certificate which can be used as proof of termination of marriage and also may be presented in cases where individuals are required to take further actions related to marital separation or divorce proceedings.
